Standard Operating Procedures for Prospective Homebuyers

Pursuant to New York State Real Property Law §442-H, d.katen fire island properties, ltd. (“Brokerage”) hereby adopts the following Standard Operating Procedures for working with prospective homebuyers.

These procedures apply to all prospective purchasers of residential real property and are provided to comply with New York State law.

1. Identification

Prospective purchasers are not required to provide identification as a condition of working with d.katen fire island properties, ltd. or viewing a property.

However, individual sellers may require identification prior to granting access to their property. In such cases, prospective purchasers may be asked to provide identification before a showing appointment is confirmed.

2. Exclusive Buyer Representation Agreement

Prospective purchasers are not required to enter into an exclusive buyer representation agreement as a condition of receiving real estate services from d.katen fire island properties, ltd.

However, prospective purchasers may choose to enter into a buyer representation agreement with the Brokerage at any time, and such an agreement may be recommended based upon the nature of the transaction and the services requested.

3. Proof of Funds / Mortgage Pre-Approval

Prospective purchasers are not required to provide proof of funds or mortgage pre-approval as a condition of viewing a property.

However, individual sellers may require proof of funds, a mortgage pre-approval letter, or other evidence of financial qualification before granting access to a property or prior to considering an offer to purchase.

4. Fair Housing

d.katen fire island properties, ltd. is committed to providing equal professional service to all clients and customers and fully complies with all Federal, State, and Local Fair Housing Laws.

The Brokerage does not discriminate on the basis of race, color, religion, creed, sex, sexual orientation, gender identity or expression, disability, familial status, national origin, military status, lawful source of income, age, marital status, or any other characteristic protected by law.

5. Agency Disclosure

In accordance with New York State law, agency disclosure forms will be provided to prospective buyers and sellers at the first substantive contact or as otherwise required by law.
